It’s not ‘fair’ and it won’t work: an argument against the ACCC’s news media bargaining code
The ACCC code isn’t the fair way to solve the problem facing news companies, argues lecturer Damien Spry in this crossposting from The Conversation. Instead, the government should be looking to regulate programmatic advertising.
Google and Facebook have threatened to limit or remove news services for Australian users, in response to the Australian Competition and Consumer Commission’s draft news media bargaining code.
This week, Facebook announced should the code become law, the company would stop letting publishers and users share local and international news on its Australian Facebook and Instagram sites.
Google has also made implicit threats to limit its Australian news services – potentially by removing Google News in Australia, as it did in Spain in 2014.

It seems to me that the ACCC has got it all wrong and is dancing to the tune of the big media organisations. What about the small ones … or the ones that are yet to come into being? Ir the ABC ot SBS. The solution above partly works. What about making the digital Godzillas pay royalties on every news click using systems like Australian Lending Rights and APRA and AMCOS. The computer power is there to do it. Once that is done perhaps Government can get around to taxing their earnings in Australia rather than in a low-tax jurisdiction. If China is a bully these American behemoths are in the same camp.
Spain and countries without Google news are not doing as badly as everyone thought.
