Sandilands sues ARN over sacking

Kyle Sandilands has commenced legal proceedings against ARN, claiming the company’s termination of his contract breached Australian consumer law.
Sandilands served copies of the court documents to Commonwealth Broadcasting Corporation, a subsidiary of ARN and the licence holder for Kiis 1065 Sydney, on Friday evening after the close of the stock market.
According to an ASX filing made by ARN on Monday morning, Sandilands is claiming the termination of his contract, announced last Wednesday March 18, was invalid as “there was no act of serious misconduct or breach of contract”.
He is seeking an order for specific performance of two contracts, payment of whatever amounts are due and payable under the contracts at the time of judgment, and damages.
The charge of serious misconduct levelled at Sandilands by ARN relates to a single program, aired on February 20, during which Sandilands berated his co-host Jackie Henderson for her interest in star charts, which Sandilands claimed was interfering with her ability to work.
Henderson took the next seven shows off, and informed ARN she couldn’t work with Sandilands in early March. Her contract was discontinued, with Sandilands given 14 days to remedy the “serious misconduct” breach on threat of termination. Henderson has indicated she will also be taking legal action.
Sandilands released a statement last Wednesday ahead of ARN’s market announcement suggesting he would file suit.
“I’ve got a contract until 2034. I’ve got rights under that contract. And ARN hasn’t honoured the contract. So, it’s over to my lawyers.”
ARN said in Monday morning’s market announcement it will defend the suit,
“ARN disputes the claims. It intends to defend the proceedings. Given the early stage of the matter, ARN is unable to reliably estimate the outcome or any potential financial impact.”
He will win , he has said things so much worse than this and Jackie laughed it off .
