Jackie O’s legal filing against ARN, word for word

Mumbrella obtained the documents of Jackie “O” Henderson’s lawsuit against radio network ARN direct from the Federal Court. Five things we didn’t know before reading the full document:

  • Henderson’s contract says it is possible for her to present the breakfast show (or another show) without Kyle Sandilands
  • Henderson’s letter of complaint to ARN before her contract was terminated unequivocally stated she could no longer work with Sandilands
  • Henderson wanted to leave breakfast, do another show without Sandilands, and keep her $10m a year fee
  • In addition to the normal fees ($82.25m over the rest of the contract), Henderson stood to gain “a share of Radio Station Revenue”
  • Kiis network boss Derek Bargwanna does not like to use the shift key while texting

The first fact sets the scene for the legal argument: it appears Henderson is attempting to de-fang ARN’s claim she blew up the contract by saying she couldn’t work with Sandilands.

We are yet to hear from ARN. The deadline for its written response to the court is 21 April, with the case management hearing (for both Sandilands’ and Henderson’s suits) on 24 April before Justice Angus Stewart in the NSW Federal Court.

THE PARTIES

The First Applicant, Jacqueline Ellen Henderson (Ms Henderson):

(a) is an individual, capable of suing in her own name;

(b) was at all material times an employee of the Second Applicant; and

(c) was at all material times a co-presenter of a live broadcast breakfast radio show on the First Respondent’s commercial radio stations in Sydney and Melbourne.
